We offer this website, including all information, products, services and tools available through it, to you subject to your acceptance of these Terms of Service and the policies referenced within them.
By visiting our website, creating an account or purchasing a product from us, you agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use the website or place an order.
These Terms of Service apply to all users of the website, including visitors, customers and anyone who submits content or feedback.
Our store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products and services to you.

Nothing in these Terms of Service affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013 or any other applicable consumer-protection legislation.

By using this website or placing an order, you confirm that you are at least 18 years old and have the legal capacity to enter into a contract.
You agree to provide accurate, current and complete information when creating an account or placing an order. You are responsible for keeping your account details, password and other login information secure.
Please notify us promptly if you believe that your account has been accessed or used without your permission.

We take reasonable care to ensure that product descriptions, photographs, colours, measurements and other information displayed on our website are accurate.
The appearance of colours and materials may vary slightly depending on your screen settings, lighting conditions and the natural characteristics of the product. These minor variations do not affect your statutory rights.
All products are subject to availability. We may withdraw, discontinue or change a product before an order is accepted. Any such change will not affect an order that we have already accepted unless we agree the change with you.
Products supplied by us must be as described, of satisfactory quality and fit for any purpose made known to us, in accordance with your statutory rights.
Our pillows and sleep accessories are intended to provide general comfort and support. Unless expressly stated otherwise, they are not medical devices and are not intended to diagnose, treat, cure or prevent any medical condition.
If you are pregnant, recovering from surgery, experiencing pain or living with a medical condition, you should seek advice from an appropriate healthcare professional before using a product where necessary.
SECTION 3 – ORDERS
Placing an order through our website constitutes an offer to purchase the products in your order.
An order acknowledgement confirms that we have received your order but does not mean that we have accepted it. A binding contract is formed when we send you confirmation that your order has been dispatched.
We may decline or cancel an order before dispatch for legitimate reasons, including:

Where permitted by law, the change-of-mind cancellation right does not apply to sealed goods that are unsuitable for return for health or hygiene reasons once their seal has been broken. This may include pillows supplied in sealed vacuum packaging.
This hygiene exception does not affect your statutory rights where a product is faulty, damaged, not as described or otherwise does not conform to the contract.
Products purchased through our website are intended for personal and household use. They must not be purchased for unauthorised resale or commercial distribution.
SECTION 4 – PRICES AND BILLING
All prices are displayed in pounds sterling and include any applicable VAT or other sales taxes unless stated otherwise.
Delivery charges are shown separately during checkout and before you place your order. Available delivery services and charges may depend on your order value and delivery address.
The price payable is the price displayed when you submit your order, except where there is an obvious pricing error.
We may change our prices or promotional offers at any time. Changes will not affect orders that we have already accepted.
Promotional offers may be subject to separate conditions, availability and expiry dates. Unless expressly stated otherwise, promotional codes cannot be used together.
You agree to provide accurate and complete payment and billing information. By submitting payment details, you confirm that you are authorised to use the selected payment method.
Payments may be processed by Shopify Payments or another third-party payment provider. Your use of a payment provider may also be subject to that provider’s terms and privacy policy.
SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates or service targets and are not guarantees. Processing time is separate from the delivery time quoted for a delivery service.
We will take reasonable steps to deliver your order within the estimated timeframe. Delivery may take longer during weekends, bank holidays, exceptionally busy periods or because of circumstances outside our reasonable control.
Unless a different delivery period has been agreed, we will deliver your order without undue delay and no later than 30 days after the contract is formed, as required by applicable law.
If we become aware of a significant delay, we will contact you where reasonably possible. Your legal rights concerning delayed or failed delivery remain unaffected.
We are responsible for the goods until they are delivered into your physical possession or the possession of a person identified by you to receive them.
If you independently arrange for a carrier that was not offered by us to collect your order, responsibility may pass to you when the goods are delivered to that carrier, as permitted by law.
Please contact us promptly if your tracking information states that an order has been delivered but you have not received it, or if the parcel arrives damaged.
SECTION 6 – INTELLECTUAL PROPERTY
All content made available through our website, including text, photographs, graphics, logos, product names, designs, videos and website layout, is owned by or licensed to J&C Commerce Ltd and is protected by applicable intellectual-property laws.

Our online store is hosted by Shopify, which supplies the ecommerce technology used to operate the website and process transactions.
Any contract for the purchase of Nurtura Sleep products is between you and J&C Commerce Ltd, trading as Nurtura Sleep. Shopify is not the seller of our products and is not responsible for fulfilling your order.
Certain information may be processed by Shopify in connection with your use of the store and your transaction. This processing is explained in our Privacy Policy and Shopify’s privacy documentation.
Nothing in this section limits any rights or remedies that cannot lawfully be excluded.

You retain ownership of your content. However, by submitting it to us, you grant J&C Commerce Ltd a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish and adapt that content for the operation and promotion of Nurtura Sleep.
